Terms and Conditions of Sale and Use
Preamble
These Terms and Conditions of Sale and Use (hereinafter "T&Cs") govern the use of the CoutureCiel service, accessible via the web application at app.coutureciel.com. By using the service, you unconditionally accept these terms.
Article 1 - Service Description
CoutureCiel is a management software (SaaS) designed for tailors, stylists, and sewing workshops. The service includes:
- Management of customer files and measurements
- Order tracking and scheduling
- SMS notifications to customers (depending on plan)
- Fabric and material inventory management
- Simplified accounting tracking
- Multi-shop management (depending on plan)
Article 2 - Free Trial Period
Duration: CoutureCiel offers a free 2-week trial period starting from account creation.
No commitment: No credit card or payment method is required to start the trial. You can cancel at any time without charges.
Features: During the trial, you have access to all features of the TERANGA plan.
End of trial: At the end of the trial period, you must subscribe to continue using the service.
Article 3 - Pricing and Payment
Available plans:
- XEWEUL : 19,900 FCFA/month - For individual entrepreneurs
- TERANGA : 29,900 FCFA/month - For SMEs
- YAATAL : 39,900 FCFA/month - For large businesses
Additional SMS: Beyond your plan's included quota, additional SMS are charged at the current rate displayed in the application.
Accepted payment methods: Orange Money, Wave, Visa/Mastercard credit cards.
Billing: Subscriptions are billed monthly on the subscription anniversary date.
Article 4 - Cancellation
Cancellation by client: You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current subscription period.
Grace period: Depending on your plan, you benefit from a grace period after expiration (1 day for TERANGA, 3 days for YAATAL).
Data export: You remain the owner of your data. In case of cancellation, you can export all your data before your account is permanently closed.
Data retention: After cancellation, your data is kept for 30 days before permanent deletion.
Article 5 - Responsibilities
CoutureCiel's obligations:
- Ensure service availability under the best conditions
- Secure user data through encryption
- Perform regular backups
- Provide technical support according to the plan
User's obligations:
- Use the service in accordance with its intended purpose
- Maintain confidentiality of login credentials
- Not attempt to bypass security measures
- Respect third-party rights and applicable regulations
Article 6 - Limitation of Liability
Availability: CoutureCiel strives to ensure optimal service availability but does not guarantee uninterrupted operation. Maintenance interruptions may occur, with prior notification when possible.
Indirect damages: Under no circumstances shall CoutureCiel be liable for indirect damages, including loss of profits, data, customers, or business opportunities.
Liability cap: CoutureCiel's total liability is limited to the amount of subscriptions paid by the customer during the last 12 months.
Force majeure: CoutureCiel shall not be held liable in cases of force majeure, including but not limited to: natural disasters, internet network failures, third-party provider failures, or government decisions.
Article 7 - Intellectual Property
CoutureCiel software: The software, its source code, interface, features, and documentation remain the exclusive property of CoutureCiel. The user benefits from a non-exclusive, non-transferable license limited to the subscription duration.
User data: The user remains the owner of all data entered into CoutureCiel (customer data, orders, measurements, etc.).
CoutureCiel commits to never sell, rent, or share this data with third parties for commercial purposes.
Article 8 - Acceptable Use Policy
The user agrees not to:
- Use the service for illegal or fraudulent purposes
- Attempt to access other users' data
- Intentionally overload servers or networks
- Resell, sublicense, or redistribute the service without authorization
- Automatically extract data (scraping) without authorization
- Introduce viruses, malware, or any malicious code
Any violation of these rules may result in immediate suspension or termination of the account, without refund.
Article 9 - Availability and Maintenance
Availability target: CoutureCiel aims for 99% availability excluding scheduled maintenance. This value is indicative and does not constitute a contractual commitment.
Scheduled maintenance: Planned maintenance is preferably performed outside business hours (GMT timezone) and notified in advance when possible.
Emergency maintenance: In case of security or stability emergency, CoutureCiel may intervene without notice to protect the service and data.
Article 10 - Applicable Law
These T&Cs are governed by Senegalese law.
In case of dispute regarding the interpretation or execution of these terms, the parties agree to seek an amicable solution before any legal action.
Failing amicable settlement, the courts of Dakar shall have exclusive jurisdiction.
Article 11 - T&Cs Modifications
CoutureCiel reserves the right to modify these T&Cs at any time. Users will be notified by email of substantial changes at least 30 days before they take effect. Continued use of the service after the new terms take effect constitutes acceptance thereof.
